This Privacy Policy is specifically tailored to our role as a marketing and lead-generation website that helps consumers shop for, and request quotes on, individual and family health insurance products for individuals under age 65. The Website offers a co-branded quote workflow powered by our partner, HealthCare.com (operated by HealthCare, Inc. and its affiliates, including HealthCare.com Insurance Services, LLC). When you elect to request quotes through that workflow, your information will also be governed by HealthCare.com's privacy policy, which you can review at https://www.healthcare.com/privacy-policy.

healthinsuranceseekers.com is not an insurance company, insurance agency, or health-care provider. We do not sell insurance and we do not provide medical care, medical advice, or treatment. We are not a "covered entity" or "business associate" under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), and information you submit through the Website is not "protected health information" as defined by HIPAA.

Information We Collect

Information collected automatically

We follow the standard industry practice of using log files. These files log visitors when they visit the Website, as well as information collected through those visits. The information collected automatically may include: Internet Protocol (IP) addresses, system and browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, the device or operating system you are using, and the pages and links you click on the Website. The purpose of this information is to analyze trends, administer and enhance the Website, secure the Website against fraud and abuse, and track visitors' movements on the Website.

Your information may be transferred to and maintained on computers located outside of your state, country, or other governmental jurisdiction where data-protection laws may differ from those of your jurisdiction.   • Communications you send to us, including questions, feedback, and customer-support requests; and
  • Any other information you voluntarily submit through the Website or to our customer-service or licensed-agent personnel.

You are not required to provide any of this information, but if you choose not to, we may not be able to match you with relevant quotes or licensed agents.

Calls made to or from telephone numbers displayed on the Website, and certain interactions on the Website itself (such as form-completion activity), may be recorded and/or monitored for quality assurance, training, compliance, fraud prevention, and to memorialize your prior express written consent to be contacted, as further described below.

Information collected from third parties

We may also receive information about you from third parties, including:

  • Our marketing and lead-generation partners (such as comparison-shopping sites, publishers, and other websites or online advertising channels through which you reached us);
  • Service providers that perform identity verification, fraud detection, lead validation, data hygiene, and analytics;
  • HealthCare.com, our co-branded quote-workflow partner, and the licensed insurance agencies, insurance carriers, and other Network Partners to whom you may be matched; and
  • Publicly available sources and consumer data resellers/brokers.

TCPA and Electronic Signature Consent

By submitting a quote request, contact form, or call-back request through the Website, you are providing your prior express written consent under the Telephone Consumer Protection Act ("TCPA") and applicable state law for healthinsuranceseekers.com, HealthCare.com, and our licensed insurance agency and carrier Network Partners (and their respective agents and service providers) to contact you at the telephone number(s) and email address you provide — including any wireless number — for the purpose of providing quotes, completing your enrollment, and marketing health insurance and related products and services. This consent permits contact by:

  • Live agents;
  • Automatic telephone dialing systems;
  • Artificial- or pre-recorded voice messages;
  • SMS or MMS text messages (message and data rates may apply); and
  • Email.

You agree that you may be contacted by these methods even if your number appears on a federal or state Do-Not-Call list, an internal company Do-Not-Call list, or any similar list. Your consent is not a condition of purchasing any goods or services, and you can revoke it at any time as described in the "Your Choices" section below.

To create a verifiable electronic record of your consent, the Website may use an independent third-party "electronic agent," such as Jornaya's LeadiD solution and/or TrustedForm, to capture and time-stamp your form-completion activity. This is done in compliance with the federal Electronic Signatures in Global and National Commerce Act ("E-Sign Act," 15 U.S.C. § 7001 et seq.). "Electronic agent" and "electronic record" are defined in Section 7006 of the E-Sign Act.

Cookies and Do Not Track Signals

  • Communicate with you about products or services that may be of interest to you, including individual and family health insurance, short-term medical, dental, vision, accident, critical illness, supplemental, and other health-related insurance products;
  • Send confirmations, updates, alerts, administrative messages, and otherwise facilitate your use of the Website;
  • Send surveys, research materials, newsletters, offers, and promotions;
  • Allow you to attribute revenue appropriately between us and our marketing partners;
  • Generate a personal profile of you to make future visits to the Website more personalized;
  • Monitor and analyze usage and trends to maintain, improve, secure, and develop the Website and the user experience;
  • Compile aggregated and de-identified statistical information and analyses, which we may use internally or share with third parties;
  • Detect, investigate, and prevent activities that may violate our policies or be fraudulent or illegal, and to comply with legal requirements;
  • Respond to your emails, inquiries, and customer-support requests; and

How We Share Your Information

Sharing with HealthCare.com and Network Partners

Because the Website offers a co-branded quote workflow powered by HealthCare.com, when you submit a request for health insurance information or quotes through the Website, you expressly authorize and direct us to share the personal information you provided (including any health-related information you chose to provide) with HealthCare.com and with the licensed insurance agencies, insurance carriers, brokers, and other Network Partners who may be able to provide you with quotes, coverage, or related products and services. Once your information is shared, HealthCare.com's and each Network Partner's own privacy policies and practices will also apply. We encourage you to review them.

A list of HealthCare.com's Network Partners is generally available at https://www.healthcare.com/partner-companies. If you do not want to receive further communications from a particular Network Partner, you must contact that Partner directly to opt out.

Sharing with service providers

We may share the information collected through the Website with our third-party service providers, including our web host, hosting and cloud infrastructure providers, analytics and advertising providers, customer relationship management ("CRM") providers, email and text-message delivery providers, call-tracking and call-recording providers, identity-verification and lead-validation providers, fraud-prevention providers, and consent-capture providers (such as Jornaya and/or ActiveProspect). You consent to the disclosure of your information collected through the Website to these third-party providers for the sole purpose of allowing them to perform the services they have contracted to provide to us.

Legal, safety, and business transfers

We may also share information when we believe disclosure is necessary or appropriate:

  • To comply with applicable laws, regulations, subpoenas, court orders, or other lawful requests by government authorities;
  • To respond to any complaint;

Aggregated and de-identified data

We may analyze aggregated and de-identified data and share these analyses at our discretion, including with marketing agencies, media agencies, analytics providers, and Network Partners. These recipients will not be able to relate this data to identifiable individuals.

Security

We utilize a combination of administrative, technical, and physical safeguards to protect against breaches of security and the data which we collect through the Website. We also contractually require service providers and Network Partners with whom we share your personal information to exercise reasonable care to protect your personal information against unauthorized access or use. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we do not guarantee the absolute security of the Website.

We retain personal information for as long as reasonably necessary to fulfill the purposes outlined in this Privacy Policy, comply with our legal and regulatory obligations (including TCPA consent record-keeping), resolve disputes, and enforce our agreements.

Children's Information

Another of our priorities is helping to protect children while they are using the Internet. The Website is not directed to children, and we do not knowingly seek to collect any personally identifiable information from children under the age of 13. We encourage parents and guardians to observe, participate in, and/or monitor and guide their children's online activities. If you think that your child has provided this kind of information on or through the Website, please contact us immediately so that we can use our best efforts to promptly remove such information from our records.

Note: Although we use the term "under-65 health insurance" to describe the products you may inquire about through the Website, the Website itself is intended only for use by adults age 18 or older who are shopping for coverage for themselves and, if applicable, their household members.

Your Choices

You have a number of choices regarding the information we collect and how we use it:

  • Marketing emails. You may unsubscribe from commercial emails from us at any time by clicking the "unsubscribe" link at the bottom of any marketing email or by contacting us at the email address listed below. If you opt out of marketing emails, we may still send you non-marketing or transactional emails (for example, emails about your active quote request or our business dealings with you).
  • Marketing calls and text messages. You may opt out of receiving marketing calls or text messages from us by replying "STOP" to any text message we send you, by asking the live agent calling you to place you on our internal Do-Not-Call list, or by contacting us using the contact information below. To opt out of calls or text messages from a particular Network Partner, you must contact that Partner directly.
  • Cookies and tracking. You may control cookies and certain other tracking technologies through your browser settings, and you may opt out of certain interest-based advertising through industry programs such as the Digital Advertising Alliance (www.aboutads.info) and the Network Advertising Initiative (www.networkadvertising.org).
  • Sale/sharing/targeted advertising opt-out. Where applicable state law provides you with the right to opt out of the "sale" or "sharing" of your personal information, or out of "targeted advertising," see the state-specific sections below.

Your California Privacy Rights

This section of the Privacy Policy is applicable only to visitors who are California residents, within the meaning of Section 17014 of Title 18 of the California Code of Regulations.   • Commercial information — such as records of products or services requested, considered, or quoted;
  • Internet or other electronic network activity information — such as time and date of your visit to the Website; time spent on the Website; referring and exit web pages; specific webpages you visited; ISP; domain name servers; types of devices accessing the Website; web browser type and version; and behavioral data (opens, clicks, form-completion events);
  • Geolocation information — such as geographic region based on IP address and area code and ZIP code associated with your device or with information you submit;
  • Audio, electronic, visual, or similar information — such as recordings of inbound and outbound telephone calls and screen/session-recordings of your interactions with the Website;

We collect this personal information directly from you (via the Website and via cookies, tags, web beacons, and tracking pixels), from our marketing and lead-generation partners, from service providers, and from HealthCare.com and the Network Partners to whom you may be matched.

We use sensitive personal information only for the purposes permitted by, or that do not require an opt-out under, Cal. Civ. Code § 1798.121 — specifically, to perform the services you have requested (i.e., to obtain and present health insurance quotes to you) and for ancillary purposes such as fraud prevention, security, and legal compliance. You have the right to limit the use and disclosure of your sensitive personal information as further described below.

Categories Disclosed or "Sold"/"Shared"

In the preceding 12 months, we have disclosed each of the categories of personal information described above to our service providers, contractors, HealthCare.com, and Network Partners for the business purposes described in this Privacy Policy.

Under the CCPA's broad definitions of "sale" and "sharing" (for cross-context behavioral advertising), our disclosure of identifiers, internet or other electronic network activity information, geolocation information, commercial information, and inferences to HealthCare.com, Network Partners, advertising networks, and certain marketing partners may be considered a "sale" or "sharing." We do not knowingly sell or share the personal information of consumers under 16 years of age.

We do not offer any financial incentives in exchange for the collection, sale, sharing, retention, or deletion of personal information.

Your California Rights

Subject to certain exceptions, California residents have the following rights:

  • Right to know. The right to request that we disclose what personal information we collect, use, disclose, sell, and share about you, including specific pieces of personal information.
  • Right to delete. The right to request the deletion of personal information we have collected from you, subject to the exceptions in Cal. Civ. Code § 1798.105(d).
  • Right to correct. The right to request the correction of inaccurate personal information we maintain about you.
  • Right to opt out of sale or sharing. The right to direct us not to "sell" or "share" your personal information.
  • Right to limit use of sensitive personal information. The right to limit our use and disclosure of your sensitive personal information to those uses necessary to perform the services or provide the goods reasonably expected by an average consumer who requests them, and to certain other purposes permitted by the CCPA.
  • Right to non-discrimination. The right not to receive discriminatory treatment for exercising any of your CCPA rights.

Two-Step Deletion Confirmation

A two-step process must be utilized for online requests to delete, whereby you first clearly submit your request to delete, and second, you separately confirm that you want your personal information deleted.

To the extent that your personal information is necessary for us to maintain for a reason set forth in Cal. Civ. Code § 1798.105(d) (including, but not limited to, completing a transaction for which the personal information was collected, providing a service you have requested, detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, debugging, or complying with a legal obligation), we may not be required to comply with your request for deletion. For instance, we are not required to delete personal information necessary to maintain suppression files for individuals who have opted out of receiving email marketing from us, or to maintain TCPA consent records.

How to Submit a Request

To submit a verifiable consumer request (right to know, delete, correct, opt out of sale/sharing, or limit use of sensitive personal information), please email us at healthinsuranceseekers@cognius.com.

For us to process your request, you may be required to submit your name, email address, and telephone number in conjunction with your request, which we will use to verify your identity and locate your information in our records. If we cannot verify your identity from the information already maintained by us, we may request additional information from you, which will only be used for verification purposes and then deleted as soon as practical (unless retention is required by law).

You may also designate an authorized agent to make a request on your behalf. If you use an authorized agent, we may require: (i) written authorization signed by you; (ii) verification of your own identity; and (iii) verification of the agent's identity. We may deny a request from an agent that does not submit sufficient proof of authorization.

We will respond to verifiable consumer requests within the time periods required by the CCPA (generally within 45 days, with one 45-day extension if reasonably necessary).

Other State Privacy Rights

In addition to the California-specific rights above, residents of certain other U.S. states have rights regarding their personal data under the state-level comprehensive privacy laws listed below. To the extent we are a "controller" or "business" (or analogous term) processing your personal data under one of these laws, we honor the rights described in this section.

Colorado, Connecticut, Virginia, and Utah residents

If you are a resident of Colorado, Connecticut, Virginia, or Utah, you may have the following rights with respect to your personal data, subject to certain exceptions:

  • Right to access. The right to confirm whether we are processing your personal data and to access such personal data.
  • Right to data portability. The right to obtain a copy of the personal data you previously provided to us in a portable and, to the extent technically feasible, readily usable format.
  • Right to delete. The right to request that we delete personal data we have collected about you.
  • Right to correct. The right to request that we correct inaccuracies in personal data we maintain about you (this right does not apply under the Utah Consumer Privacy Act).
  • Right to opt out of targeted advertising. The right to opt out of the processing of your personal data for purposes of targeted advertising.
  • Right to opt out of sale. The right to opt out of the "sale" of your personal data (as that term is defined under your state's law).
  • Right to opt out of profiling that produces legal or similarly significant effects. We do not currently engage in profiling that produces such effects.

Colorado residents also have a right to opt out of the processing of sensitive data; we will not process the limited sensitive personal data described above for purposes other than providing the quote and matching services you have requested without first obtaining your consent where required by the Colorado Privacy Act.

How to submit a state-law privacy request

To exercise any of these rights, please email us at healthinsuranceseekers@cognius.com with the subject line "State Privacy Rights Request" and indicate the state in which you reside and the right you wish to exercise. We will need to verify your identity (typically by matching information you provide with information we already maintain about you) before fulfilling your request.

We will respond to your request within the time period required by your state's law (typically 45 days, with one extension where allowed). If we decline to take action on your request, you have the right to appeal that decision by replying to our response email or by contacting us at the email address above; we will respond to your appeal within the time period required by your state's law.

Colorado residents may contact the Colorado Attorney General to file a complaint at 1-720-508-6000. Connecticut residents may contact the Connecticut Attorney General at 1-860-808-5318. Virginia residents may contact the Virginia Attorney General. Utah residents may contact the Utah Attorney General or the Utah Division of Consumer Protection.

Non-discrimination

We will not discriminate against you for exercising any of the rights described in this Privacy Policy. We will not deny you goods or services, charge you different prices or rates, or provide a different level or quality of goods or services solely because you exercised your rights, except as permitted by applicable law.

Non-U.S. Users

The Website is intended for use only by persons located in the United States. We do not direct the Website to, or knowingly collect personal information from, individuals located outside the United States. If you access the Website from outside the United States, you do so at your own initiative and are responsible for compliance with local laws.

Third-Party Websites and Services

This Privacy Policy does not apply to those third-party properties. We are not responsible for the content or privacy practices of any third-party websites or services. This Privacy Policy applies only to our online activities and is valid for visitors to our Website with regard to the information that they share or which is collected on or through the Website. This Privacy Policy is not applicable to any information collected offline or via channels other than the Website.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, in technology, in applicable law, or for other operational reasons.
